Terms and Conditions (T&C)
Welcome to GINA.sg. Please read the following Terms and Conditions carefully before using this Chabot and/or the Services (defined below), so that you are aware of your legal rights and obligations with respect to the Chabot (“GINA.sg”) and/or its related entities and affiliates (individually and collectively). GINA.sg (also known as “GINA”) is owned and operated by Pand.ai Pte Ltd (“Pand.ai”), Singapore Company Registration No. 201619368W, makes available to you in accordance with the following Terms and Conditions of Use. If you do not agree to these Terms and Conditions or changes thereto then you must immediately stop using GINA.sg and/or the Services.
1. Agreement
1.1. You hereby represent and warrant that:
(a). You have read, agree and consent to these Terms and Conditions;
(b). You are at least 18 years old and have the necessary legal capacity, right, power and authority to agree to these Terms and Conditions and you are accessing GINA.sg, using the Services and contracting in your own personal capacity;
(c) All of the information provided to GINA.sg (including without limitation personal particulars and contact information) is accurate and complete. If in connection with your use of GINA.sg, you provide the Personal Data of any third parties, you further warrant and represent that these third parties have also consented to these
(d) Terms and Conditions, and to the collection, use and disclosure of their Personal Data in accordance with the aforesaid.
1.2 GINA.sg may from time to time vary, replace, delete, supplement or amend the Terms and Conditions at any time on GINA.sg and the domain https://www.gina.sg (“Site”).
1.3. The service offered through GINA.sg is intended primarily for Singapore citizens, Singapore permanent residents or foreign nationals residing in Singapore under a valid work or residency permit.
1.4. If you are accessing GINA.sg from a jurisdiction other than Singapore, you are wholly responsible for complying with all restrictions and conditions imposed on you by the said jurisdiction. Even if GINA.sg is available for your use from outside of Singapore, this should not be construed as us having assessed that there is no restriction or condition imposed by any foreign jurisdiction on you.
2. Content Use Conditions
2.1. You agree not to reproduce, display or otherwise provide access to the Services, GINA Content, or Third Party User Content on another website or server, for example through framing, mirroring, linking, spidering, scraping or any other technological means (including any technology available in the future), without the prior written permission of Pand.ai.
2.2. You may for your personal, non-commercial use:
(a). retrieve and display GINA Content on any compatible device owned by you;
(b). print a single copy of GINA Content on paper (but not photocopy them); and
(c). store such GINA Content in electronic form on disk or on a mobile device owned by you (but not on any server or other storage device connected to a network).
2.3. All GINA.sg Content are the copyrighted work of Pand.ai, and Pand.ai reserves and retains all rights in the GINA Content. Use of some GINA content may be governed by the terms of an accompanying end user license agreement.
2.4. All quotes generated through GINA.sg are subject to change without prior notice and photos shown are for illustrative purpose only.
3. Intellectual Property Rights
3.1. All Trade Marks are registered and unregistered trademarks of Pand.ai.
3.2. All Content generated from GINA.sg or published on our Site is the property of Pand.ai, its related corporations, and/or third parties. You may not reproduce, modify, adapt, translate, republish, copy, display, broadcast, communicate, transmit, podcast, webcast, distribute, sell, trade, mirror, frame, transfer, store, or in any other fashion re-use the Content in any manner or by any means unless given express written permission by us, our related corporations and/or third parties to do so.
4. Disclaimers & Limitations
4.1. Neither GINA.sg nor Pand.ai, at any time, underwrite, originate, or issue insurance policies and/or insurance contracts.
4.2. The underwriting, origination, and issuance of the insurance policies and/or insurance contracts are the sole provision and responsibility of the respective insurance company that a User may contract with through the mobile application owned and offered by Pand.ai Pte. Ltd through the digital insurance broker, GINA.sg. Thus, any policies, liabilities, coverage, or responsibilities relating to an insurance policy purchased through GINA.sg remain the sole province of the insurance company that provided that policy/contract.
4.3. GINA.sg is unable to mediate or dispute any claims or other issues related to the liability, coverage, or scope of any insurance product.
4.4. Neither GINA.sg nor Pand.ai will be liable for any mistake, error, or omission that may occur during the electronic processing of the policies/contracts on the mobile application or policy management function.
4.5. Pand.ai will use its best efforts to ensure that any mistake, error, or omission on its mobile application or policy management function is corrected when discovered.
4.6. Users should inform GINA/Pand.ai if they discover any mistake, error, omission, and/or update in the policies/contracts or their user details.
5. Linked Sites
5.1. GINA may provide links to other sites (“Linked Sites”) that may be of relevance and interest to users. GINA has no control over, and is not responsible for, the content on the Linked Sites or for any damage you may incur from the Linked Sites (including any virus, spyware, malware, worms, errors or damaging material contained in the Linked Sites) or the availability of any content on the Linked Sites, and you hereby irrevocably waive any claim against us with respect to the Linked Sites.
5.2. Links on GINA.sg to third-party websites are provided solely as a convenience to you. If you use these links, you will leave GINA.sg. We have not reviewed all of these Linked Sites and do not control and are not responsible for any of these sites or their content. Thus, we do not endorse or make any representations about them, or any information, software or other goods or materials found there, or any results that may be obtained from using them. If you decide to access any of the Linked Sites linked to the Site and/or GINA.sg , you do this entirely at your own risk.
6. Data Use & Privacy
6.1. The foregoing consents provided by you in Clause 1 supplements but does not supersede nor replace any other consents you may have previously provided to GINA in respect of your Personal Data, and your consents herein are additional to any rights which we may have at law to collect, use or disclose your Personal Data. Please refer to GINA’s Privacy Policy for more information.
6.2. GINA may provide links to Linked Sites whose data protection and privacy practices may differ from those set forth here. We are not responsible for the content and privacy practices of these other websites and you agree to review and abide by the data protection and privacy notices of those sites.
6.3. “Personal Data” refers to any data or information about you from which you can be identified either (i) from that data; or (ii) from that data and other information to which we have or are likely
(a). Your name, NRIC, Passport or other identification number, mobile number, mailing address, email address, marital status, gender, date of birth, profession and any other information relating to you which you have provided us in any forms you may have submitted to us, or in other forms of interaction with you;
(b). Your driving history, vehicle details, and any other information related to motor vehicle;
(c). Your payment related information.
6.4. Generally, GINA.sg collects your Personal Data in the following ways:
(a). when you submit forms or other documents relating to any of our products or services;
(b). when you interact with our customer service officers;
(c). when you use some of our services;
(d). when you request that we contact you;
(e). when you respond to our request for additional Personal Data;
(f). when you respond to our promotions and other initiatives;
(g). when you submit your Personal Data to us for any other reason.
6.5. When you using GINA.sg, you generally do so anonymously. GINA/Pand.ai does not automatically collect Personal Data unless you provide such information to us.
6.6. If you provide GINA with any Personal Data relating to a third party (e.g. information of spouse, children, parents, employees and/or authorised representatives), by submitting such information to GINA that you have obtained the consent of the third party to you providing GINA with their Personal Data for the respective purposes.
6.7. You warrant and represent to GINA that all personal data which is submitted to GINA.sg by you through your use of GINA.sg is complete, accurate, true and correct. Failure on your part to do so may result in our inability to provide you with products and services you have requested, or processing any requests and applications you may have made to us.
6.8. Generally, GINA collects, uses and discloses your Personal Data for the following purposes:
(a). responding to, processing and handling your queries, requests, complaint and feedback;
(b). preventing, detecting and investigating crime, including fraud and money-laundering, and analyzing and managing other commercial risks.
6.9. In addition, where permitted under the applicable laws, GINA may also collect, use and disclose your Personal Data, and share your Personal Data with GINA’s business partners and/or other third parties for the following purposes:
(a). matching Personal Data with other data collected for other purposes and from other sources (including third parties) in connection with the provision or offering of products and services, whether by GINA or other third parties;
(b). conducting market research, data analytics, understanding and determining customer location, preferences and demographics for us, our service providers and/or other third parties to develop insights into the industry, review, develop and improve our, our business partners', service providers' and/or other third parties' products, services and also develop special offers and marketing programmes.
6.10. You may withdraw your consent for receiving marketing or promotional materials/communication by contacting us using the contact details below. Once we receive confirmation that you wish to withdraw your consent for marketing or promotional materials/communication, it may take up to 30 calendar days for your withdrawal to be reflected in our systems. Therefore, you may still receive marketing or promotional materials/communication during this period of time. Please note that even if you withdraw your consent for the receipt of marketing or promotional materials, we may still contact you for other purposes in relation to the products and services that you have requested or purchased from GINA.
6.11. GINA/Pand.ai will take reasonable steps to protect your Personal Data against unauthorised disclosure. Subject to the provisions of any applicable law, this Personal Data may be disclosed to the third parties, whether they are located overseas or in Singapore.
7. Notification of Infringement
7.1. Pand.ai reserves the right to investigate notices of copyright, trademark and other intellectual property infringement (“Infringement”) in respect of GINA Content and other material on the Site and/or GINA.sg (“Infringing Material”) and take appropriate action. If you believe that your work has been used or copied in a way that constitutes Infringement and such Infringement is occurring on the Site and/or GINA.sg, please notify GINA.sg/Pand.ai in writing immediately via email and containing the information prescribed by the Singapore Copyright Act (Cap. 63) (“Infringement Notice”).
7.2. All Infringement Notices shall be delivered by hand to us at the following address:

7.3. Pand.ai will duly consider all Infringement Notices submitted in the above manner. In return, you agree that you shall not take any legal action or exercise any legal remedy you may have against GINA in respect of any copyright infringement, unless you have first given GINA the Infringement Notice and sufficient opportunity to remove the infringing material, and only if GINA refuse or fail to remove the infringing material within a reasonable time. Where GINA remove the infringing material in response to your Infringement Notice, you agree not to exercise and you hereby waive any right of action against us under any applicable laws which you may have in respect of any infringing material appearing on the Site and/or the Chatbot prior to such removal by us.
7.4. You acknowledge and agree that GINA have no control and cannot undertake responsibility or liability in respect of infringing material appearing on Linked Sites or other third party sites.
8. Exclusion and Limitation of Liability
8.1. GINA.sg/Pand.ai will not be liable for (i) any loss of profit, business or revenue, (ii) any costs or expenses, or any special, indirect or consequential damages of any nature whatsoever, suffered or incurred by you as a result of or in connection with the provision of access to GINA.sg.
9. Indemnity
9.1. You agree to indemnify and hold Pand.ai handling or otherwise providing access GINA.sg, from and against any and all claims, actions, demands, proceedings, liabilities (present, future, contingent or otherwise on an indemnity basis), which may be suffered or incurred by GINA as a result of or in connection with a breach of these Terms and Conditions by you.
10. Rights of Third Parties
10.1. Nothing in these Terms and Conditions is intended to, nor shall create any right enforceable by any third party.
11. Governing Law & Jurisdiction
11.1. This Terms and Conditions shall be governed by and construed in accordance with the laws of Singapore including without limitation the provisions of the Singapore Evidence Act (Chapter 97) and the Electronic Transactions Act (Cap. 88), without giving effect to any principles of conflicts of law.
11.2. You hereby agree to submit the non-exclusive jurisdiction of the courts of Singapore.
